Elle p\u00e8se sur :<\/p>\n<ul>\n<li>Les personnes morales de droit public et de droit priv\u00e9 employant au moins cinquante agents\/salari\u00e9s, \u00e0 l\u2019exclusion des communes de moins de 10 000 habitants ;<\/li>\n<li>Les administrations de l\u2019Etat ;<\/li>\n<li>Toute autre entit\u00e9 relevant du champ d\u2019application des actes de l\u2019Union europ\u00e9enne mentionn\u00e9s en annexe de la directive sur la protection des lanceurs d\u2019alerte.<\/li>\n<\/ul>\n<p>Le seuil de cinquante salari\u00e9s s\u2019appr\u00e9cie \u00e0 la cl\u00f4ture de deux exercices cons\u00e9cutifs et est d\u00e9termin\u00e9 selon les modalit\u00e9s pr\u00e9vues au I de l\u2019article L. 130-1 du code de la s\u00e9curit\u00e9 sociale, selon lequel l\u2019effectif salari\u00e9 correspond \u00e0 la moyenne du nombre de personnes employ\u00e9es au cours de chacun des mois de l\u2019ann\u00e9e civile pr\u00e9c\u00e9dente.<\/p>\n<p>D\u2019autres lois pr\u00e9voient \u00e9galement, dans des domaines sp\u00e9cifiques, l\u2019obligation de mettre en place une ligne d\u2019alerte.<\/p>\n<p>C\u2019est le cas notamment de l\u2019article 17 de la loi Sapin II, qui oblige les soci\u00e9t\u00e9s et groupes employant au moins 500 salari\u00e9s et r\u00e9alisant un chiffre d\u2019affaires de plus de 100 millions d\u2019euros \u00e0 mettre en place une ligne d\u2019alerte en mati\u00e8re de corruption.<\/p>\n<p>C\u2019est \u00e9galement le cas de la loi sur le devoir de vigilance, qui oblige les soci\u00e9t\u00e9s et groupes soumises \u00e0 mettre en place une ligne d\u2019alerte pour recueillir les signalements relatifs aux atteintes graves envers les droits humains et les libert\u00e9s fondamentales, la sant\u00e9 et la s\u00e9curit\u00e9 des personnes ainsi que l\u2019environnement, r\u00e9sultant des activit\u00e9s des entreprises concern\u00e9es.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Mise \u00e0 jour du 12 janvier 2024 L\u2019obligation g\u00e9n\u00e9rale de mettre en place un dispositif d\u2019alerte r\u00e9sulte de l\u2019article 8 de la loi Sapin II.
